In a Chapter 7 Bankruptcy, none of the debt is paid back and there are limitations on the value and types of assets that can be kept and the income of the person or persons filing.

A Chapter 13 is a reorganization and it can take up to five (5) years for the case to conclude. It takes that long because, in a Chapter 13, the Debtor (person owing money) is paying some of those debts. The Debtor pays based on their income, expenses and the types of debts that need to be paid back. Some debts, like those to the IRS, must be paid back in full which can make the Plan take five (5) years or less depending on how much is owed.
